Short Profile

Christian Karbaum is a partner at GLADE MICHEL WIRTZ in the COMPETITION practice. He advises German and international clients on issues relating to German and European competition law. His practice focuses on transactional advice (especially merger and foreign direct investment control), antitrust fine and administrative proceedings, compliance advice and litigation, especially in the enforcement and defense of antitrust damages claims as well as claims related to market power/the DMA.

Christian Karbaum studied law at the University of Osnabrück and at the Université Paris-Est Créteil Val de Marne. His doctorate thesis regarding "Competition law compliance – Legal foundations and implementation", which was supervised by Prof Dr Fuchs, University of Osnabrück, was sponsored with a scholarship from the "Business and Law Working Group" in the Stifterverband für die Deutsche Wissenschaft. Christian Karbaum is a founding member and academic advisor of the CUR Centre for Corporate Law at the University of Osnabrück e.V., a member of the Studienvereinigung Kartellrecht e.V. and the C.L.F. Competition Litigation Forum e.V. He speaks German (mother tongue) and English and has a good knowledge of French.

Christian Karbaum spends as much time as possible with his wife and two sons, friends, sports (cycling, running, hiking), and literature.

Examples of Christian Karbaums's recent experience include:

  • Defence of companies and individuals in cartel investigations (including the cases "special mining services", "rail technology", "power transformers", "mill cartel", and "food retail" before the Federal Cartel Office)
  • Litigation: Defence and enforcement of cartel damage claims (defence e.g. in the cartel cases "rail technology", "beer", "flour", "drugstore products", "sanitary fittings", "sausages", "retail food packaging", and "gas insulated switchgears" as well as active representation of individual claimants in the cases "aluminium forges", "steel forges", "building equipment cartel", "stainless steel", "heavy plates", "air cargo" (COM), "high voltage cables" (COM) and "fire-fighting vehicles"), defence and enforcement of antitrust claims in the context of market power (e.g. access or supply claims in the context of data pools or platforms as well as advice on the enforcement of standard-essential patents (e.g. from Samsung) and of the DMA
  • Administrative matters: representation of companies like Deutsche Telekom AG (e.g. in the context of the acquisition of Unitymedia by Vodafone) as well as a fuel supplier in administrative and court proceedings following third-party complaints before the European Commission, the Federal Cartel Office and both national and European courts
  • Merger and foreign direct investment control/Advice on the preparation and implementation of mergers, e.g. Scania AB on the establishment of a joint venture with Sennder, Provinzial Rheinland on its merger with Provinzial Nordwest; United Internet AG on its takeover bid for Tele Columbus AG, the acquisition of Strato AG and Drillisch AG or the creation of an affiliate marketing network (AWIN AG) with Axel Springer; Haniel in the acquisition of Emma Sleep ("Bettzeit"), Rovema or Rentokil Initial's Continental European business; AHG in the sale of its clinic operations to Median; private equity funds such as EMH Partners etc.
  • Compliance: Advice on distribution antitrust issues, the negotiation and implementation of cooperation agreements between competitors, cooperation in affiliated groups, the design of B2B and B2C marketplaces, and the development and review of compliance structures and internal investigations
